Contract Requirements with Specification Sheet

An important feature of a proposal request based on a contract requirement with a specification sheet is that the technical planning phase of the measures to be adopted in sewage construction is generally already completed.

The instructing party must describe the service so comprehensively on the basis of the planned construction proposal that all tenderers understand the description in the same way and can calculate their prices without comprehensive preparation (VOB/A § 9, No.1). For this purpose, the service should be described, for instance, by means of a general description of the construction tasks (introductory remarks to the specification sheet), diagrammatic depiction, available reports, technical calculations and a specification sheet (LV) divided into sections. The specification sheet thus represents a negative of the activities and working steps proposed in the scope of the execution planning. This requires a high degree of professionalism on the part of the instructing party or, if required, the assistance of a professional. Only completely described construction measures ensure the instructing party that all the tenderers have calculated the same services.

The description of the LV permits an immediate price comparison between several tenders. The general contractor can also create a price level for several partial services in order thus to be able to subject the tenders to a numerical, technical and economic test according to VOB/A § 23.

If they so desire, the tenderers can also present economically better special schemes for the proposal request with specification sheet. These schemes for change or subsidiary tenders must, however, as usual, be included in the tender for special installations and must be marked as such (VOB/A § 21, No. 3). Changes to the tender documents are not permitted.
