Choice Between Contract Requirements with an Obligatory Results Programme and with a Specification Sheet

What type of contract requirements in a proposal request is finally deemed to be "more suitable" for the particular case depends on a multitude of factors. The more the planning is moved into the proposal request, the more the proposal request should move in the direction of the obligatory results programme.

If one views the present proposal request practice in the execution of sewer rehabilitation, then one finds that §, in comparison with new sewer construction, there are an above-average number of deviations from the VOB/A § 9 (3) contract requirements described as usual with specification sheets. Often a contract requirement with obligatory results programme in accordance with VOB/A § 9 (10) should be used [Mölle97]. Reasons for this, on the one hand, are the lack of willingness of the sewer operators to decide on the numerous different and, with reference to their capacity features, not yet completely investigated rehabilitation processes, that are suitable for the present case and, on the other hand, an insufficient planning of the execution.

Experience has shown that in this form of proposal request the sewer operator often obtains answers with almost the whole palette of rehabilitation possibilities so that a technical evaluation cannot be made, or only to a limited extent, due to lack of comparison. For this reason and in view of the economic situation at the time and the known investment requirements, it seems practicable, in order to keep the costs low, not to pass on the planning of rehabilitation measures on to the tenderer but to return again to contract requirements based on a specification sheet [Mölle97].
